International Arbitration in a Global Economy: The Challenges of the Future

It is with great pleasure that we invite you to the Inaugural Herbert Smith-SMU Asian Arbitration Lecture.

Our distinguished speaker, Bernard Hanotiau, will speak on International Arbitration in a Global Economy: The Challenges of the Future.  

About the Speaker

Bernard Hanotiau is a member of the Brussels and Paris bars. He is a member of the ICCA Council, of the Council of the ICC Institute and a member of the ICC International Arbitration Commission. He is also Vice-President of CEPANI (Belgian Arbitration Center) and of the Institute of Transnational Arbitration (Dallas, Texas), and a past Vice-President of the LCIA Court . He is on the Panel of arbitrators of numerous institutions, including the ICC, LCIA, ICSID, ICDR, SIAC, HKIAC, the Stockholm Chamber of Commerce, CIETAC, BAC, and the Japan Commercial Arbitration Association. He is also frequently appointed as arbitrator in UNCITRAL and other ad-hoc arbitration cases. Since 1978, he has been involved in more than 300 international arbitration cases as chairman, co-arbitrator, sole arbitrator, counsel or expert in all parts of the world.

Synopsis of Conference

The forces of globalization have generated an increased number of international contracts, generating themselves an enormous increase in complex commercial disputes. They have fueled the development of international arbitration as the preferred choice of businessmen for the resolution of their disputes. They have further led to a denationalization of arbitration, both procedurally and substantively, as well as to a convergence of national legislation and institutional rules, based on a consensus  on a greater liberalization of the process. The forces of globalization have also opened the door to the application by arbitral tribunals of general principles of international commercial law, common to all nations, and have contributed to the development of an international arbitration culture. Beyond its success, international arbitration is facing today many challenges. There is an increased concern over its judicialization, its time and cost efficiency and various ethical issues. What can be done to overcome these challenges and make sure that arbitration will continue to offer the qualities and advantages that have been the keys of its success?
